Terms and conditions
These terms and conditions govern room bookings made directly through our website www.altebruecke.de. Last updated: July 2026.
1. Scope
These terms and conditions apply to all contracts for the rental of hotel rooms between Gasthof zur alten Brücke, owner Michael Mogler, Schramberger Str. 13, 77761 Schiltach (hereinafter “we” or “host”), and the guest, concluded directly via our website. For bookings made through intermediary platforms such as Booking.com, section 7 of these terms applies.
2. Conclusion of contract and payment
By submitting your booking request via our website, you make a binding offer to conclude an accommodation contract. The contract is concluded once we confirm your booking and the total booking amount has been successfully charged via the payment provider Stripe.
Payment is made in full in advance at the time of booking via Stripe using the payment methods offered there (e.g. credit card). Once payment has been successfully processed, the agreed room price is paid in full; no further payment for the booked service is due on arrival, unless you make use of additional services (e.g. restaurant, drinks).
All prices stated are in euros and include statutory VAT.
3. No statutory right of withdrawal
Under § 312g (2) no. 9 of the German Civil Code (BGB), contracts for accommodation for a specific date or period are exempt from the statutory consumer right of withdrawal that otherwise applies to contracts concluded off-premises and distance contracts. Accordingly, you do not have a statutory right of withdrawal for bookings made via our website; the conditions set out in section 4 apply instead.
4. Cancellation, no-show, and early departure
Direct bookings made via our website are binding and require full advance payment. Free cancellation is not possible.
If you cancel a booking, fail to arrive on the booked date (no-show), or depart early, the agreed total price remains payable in full, or is retained by us. However, we will credit you with the value of any expenses we saved as well as any other income earned from re-letting the room during the same period.
Your right to prove that we incurred no loss, or a substantially lower loss, as a result of your non-use of the booking remains unaffected.
In justified exceptional cases (e.g. serious illness, death of a close relative), we will decide at our reasonable discretion on a full or partial refund upon presentation of suitable evidence.
5. Withdrawal by the host
We are entitled to withdraw from the contract for good cause, in particular in cases of force majeure or other circumstances beyond our control that make performance of the contract impossible, in cases of misleading or false information regarding the guest's identity, or where there is reasonable cause to believe that use of the service could jeopardise the smooth operation, safety, or reputation of the establishment.
In such cases, we will refund any payments already made in full. Further claims by the guest are excluded, unless we are guilty of intent or gross negligence.
6. Arrival and departure
Rooms are available from 3:00 pm on the day of arrival. On the day of departure, we ask you to vacate the room by 11:00 am. Deviating times are possible by prior arrangement and subject to availability.
7. Bookings via Booking.com and other platforms
If you do not book a room directly via our website but through an intermediary platform such as Booking.com, the general terms and conditions as well as the payment and cancellation terms of that platform take precedence. In this case, these terms and conditions apply only supplementarily to the stay itself, insofar as the platform's terms do not provide otherwise.
8. Guest obligations and house rules
The guest is liable for any damage to the building, fixtures, and inventory culpably caused by them, their companions, or visitors.
Pets may only be brought along by prior arrangement with us.
Smoking is not permitted anywhere inside the building, for fire safety reasons and out of consideration for other guests.
9. Liability
We are liable in accordance with statutory provisions for damages arising from injury to life, body, or health, as well as for other damages arising from an intentional or grossly negligent breach of duty by us, our legal representatives, or vicarious agents.
For other damages, we are only liable in the event of a breach of a material contractual obligation (cardinal obligation), the fulfilment of which is a precondition for the proper performance of the contract and on whose observance the guest may regularly rely; in such cases, liability is limited to the foreseeable damage typical for this type of contract.
We are liable for items brought in by the guest in accordance with the statutory provisions of §§ 701 et seq. of the German Civil Code (BGB).
10. Data protection
Information on the processing of your personal data, in particular in connection with payment processing via Stripe, can be found in our privacy policy.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the guest is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contractual relationship is Schiltach.
Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
